Law of Contracts and Obligations

Contract and obligations law forms the foundation of our practice, both in terms of advisory services and litigation. Our primary focus is on commercial contracts. We assist throughout all stages of a contract's life cycle. Most contracts are entered into, fulfilled, and terminated in the usual manner. However, for commercial contracts, we are often contacted when something goes wrong. In extreme cases, this may result in litigation. There are, however, many ways to resolve a contract dispute, including various types of out-of-court settlements and legal settlements, such as court mediation.

Kristensen has specialized expertise in business transfers and company transfers. Our expertise is sought primarily in exceptional situations. For our regular clients, we provide legal reviews of companies, also known as "due diligence," either on the seller's or buyer's side. We have carried out large transactions and have involved different areas of expertise in the projects, including financial and technical expertise. These are networks we can leverage if necessary.

We have extensive experience with architect and design contracts, as well as land-based and offshore construction contracts, both in contract drafting and dispute resolution.

Kristensen's work in the shipping sector mainly relates to maritime insurance, buying and selling, newbuilding, chartering, financing, and dispute resolution connected to the aforementioned business areas.

For our regular clients, we address labor law issues and handle employment law cases, primarily assisting the employer side. In cases of termination and dismissal, it is essential that we are familiar with the decision-makers and understand what motivates them.

Under obligations law, we also cover compensation and insurance law. Compensation and insurance law is one of the areas in which we have specialized expertise. Compensation involves economic compensation for damage caused. This is extensive in terms of the life areas it regulates. We focus on professional liability or similar responsibility. Kristensen provides litigation services in areas such as:

  • Board member liability

  • CEO liability

  • Shareholder liability

  • Bank liability

  • Underwriter liability

  • Consultant and advisor liability

  • Broker liability

  • Auditor liability

  • Public sector liability

Although our primary focus is on litigation related to compensation and insurance, many of these cases are resolved through settlements during the process.
